Abstract: Ghana’s construction industry is failing to properly meet infrastructure demand. Over the years, the industry has been characterised by delays, poor quality work, and cost overruns among other things. The lack of a proper regulatory mechanism has been cited as the culprit. Industry players have thus proposed the formation of a central regulatory agency as the ultimate solution. Past research indicates that although much has been done in this regard, the actual formation is yet to be realized due to a number of challenges. This outcome exists partly because the nature of problems involved in industry reform has not fully been considered. Understanding the complexity of these problems is therefore imperative. The analysis is framed using the concept of “super wicked problems” which asserts that many of the key decisions confronting policy-makers are multidimensional, time bound, and involve many stakeholders each possessing a different solution to the problem. The policy making tragedy created by the combined effect of these features creates a phenomenon where, although it is widely agreed that steps ought to be taken to quickly forestall catastrophic future impacts, it becomes difficult to do so. Developed mainly from a critique of relevant literature, this paper presents a theoretical framework for the predicaments facing stakeholders (policy makers and reform advocates) of construction industry regulation.
